WHAT IS A 1031 EXCHANGE?

Internal Revenue Code Section 1031 enables a taxpayer to defer gain on the sale of a business use or investment property, provided that he reinvests in another business use or investment property. This tax liability is forgiven upon death as your heirs receive a stepped up basis on the inherited property. Therefore, you can not only defer but totally eliminate the gain.

To defer all capital gains, you must acquire a replacement (new) property with equal or greater property value to that of the relinquished (selling) property. You must also reinvest all net equity.
